1. Offers:
All offers made by Luxury Hotel Cosmetics and International Hotel Supply Company are free of obligation.
2. Prices/Payments:
All
prices charged by Luxury Hotel Cosmetics and International Hotel Supply
Company are exclusive of VAT, unless stated otherwise.
Unless explicitly agreed otherwise, payment must be made within fourteen calendar days of the invoice date.
If you are ordering from us for the first time, the first three shipments will be subject to payment in advance.
3. Delivery:
Orders are delivered ex works Sassenheim; transport costs are passed on subsequently according to cost.
4. Tolerances:
Over or underproduction of 10% of the products ordered by you is possible.
5. Warranty:
International
Hotel Supply Company and Luxury Hotel Cosmetics gives a warranty on
articles or parts of articles which International Hotel Supply Company
and Luxury Hotel Cosmetics does not manufacture itself, if and in so far
as the supplier of International Hotel Supply Company and Luxury Hotel
Cosmetics has given International Hotel Supply Company and Luxury Hotel
Cosmetics a warranty. Upon a customer’s request, International Hotel
Supply Company and Luxury Hotel Cosmetics can inform the customer of the
warranty terms of the suppliers of International Hotel Supply Company
and Luxury Hotel Cosmetics. International Hotel Supply Company and
Luxury Hotel Cosmetics ’ liability on the basis of the warranty shall be
limited to replacement of the faulty articles, or refund of the sum
paid for these faulty articles, at the discretion of International Hotel
Supply Company and Luxury Hotel Cosmetics.
6. Cancellation / Modification:
Unless
otherwise agreed, cancellation of or changes to a (sample) order placed
with International Hotel Supply Company and Luxury Hotel Cosmetics will
not be possible if the order is already being processed.
The warranty shall not in any case cover defects which are wholly or partially due to:
- failure to observe the operating and maintenance instructions, or use other than the foreseen normal use.
- normal wear and tear;
- application of any government rules relating to the nature and quality of the materials used;
-
materials or goods which the customer has provided to International
Hotel Supply Company and Luxury Hotel Cosmetics for processing;
- materials, goods, working methods and constructions, in so far as used on the explicit instruction of the customer;

articles obtained by International Hotel Supply Company and Luxury
Hotel Cosmetics from third parties, in so far as the third parties have
not given International Hotel Supply Company and Luxury Hotel Cosmetics a
warranty;
- incompetent use or use for any purpose other than that which is customary.
7. Complaints:
The
customer must inspect the articles delivered to him. Complaints
relating to the delivered articles must be reported to International
Hotel Supply Company and Luxury Hotel Cosmetics no later than 24 hours
from receipt of the articles. If the customer has not protested against
the delivered articles in writing within the above-mentioned period,
International Hotel Supply Company and Luxury Hotel Cosmetics shall have
performed the contract properly with respect to the customer.
After
the complaints have reached International Hotel Supply Company and
Luxury Hotel Cosmetics in accordance with the foregoing, International
Hotel Supply Company and Luxury Hotel Cosmetics will launch an
investigation into the validity of the complaint. The customer must
allow representatives of International Hotel Supply Company and Luxury
Hotel Cosmetics to examine the articles in question. On the basis of
this examination, International Hotel Supply Company and Luxury Hotel
Cosmetics will decide whether the complaint is valid or not. If the
complaint is valid, International Hotel Supply Company and Luxury Hotel
Cosmetics may, at their discretion, replace the articles or credit the
customer for a sum equal to the price due from the customer for the
articles in question. If International Hotel Supply Company and Luxury
Hotel Cosmetics and the customer cannot reach agreement regarding the
validity of the claim, this decision will be left to an expert to be
appointed by the parties in consultation. With respect to complaints
about articles delivered by package, International Hotel Supply Company
and Luxury Hotel Cosmetics cannot be obliged to credit the customer for
the price of the articles delivered by package if the articles delivered
by package have been used wholly or in part by the customer. The
expert’s decision will be binding. The costs of this expert examination
will be payable by the party whom the expert has put in the wrong.
International
Hotel Supply Company and Luxury Hotel Cosmetics will notify the
customer in writing that it wishes to make use of such an expert
examination. The customer will nevertheless have the right for a period
of one month to place this dispute before the court having jurisdiction
according to these Terms and Conditions.
Return
shipments of the delivered articles will be permitted only if explicit
permission has been given to do so by an authorized employee of
International Hotel Supply Company and Luxury Hotel Cosmetics.
8. Liability:
International
Hotel Supply Company and Luxury Hotel Cosmetics shall not under any
circumstances be liable for more than compensation of the invoice value
of the articles as a result of which the customer has suffered a loss.
International
Hotel Supply Company and Luxury Hotel Cosmetics shall not be liable if
articles prove not to be suitable for the purpose for which the customer
purchased them. The Customer must therefore have informed himself in
advance about the suitability of articles for the purpose for which he
intends them.
The
customer indemnifies International Hotel Supply Company and Luxury
Hotel Cosmetics for claims of third parties against the customer for
compensation of losses on the basis of any liability whatsoever.
